Terms and Conditions

Contract
In these booking conditions, ‘you’ and ‘your’ means all people named on the booking form (including anyone who is replaced at a later date). ‘We’, ‘us’ and ‘our’ means Bluebell Riverside cabin, (Bluebell)  Rocksea Mill Cottage, Dinhams Bridge, St Mabyn, PL30 3BP.

This agreement is made on the basis that the property is to be occupied by the guests for a holiday as mentioned in the Housing Act 1988 Schedule 1 paragraph 9 and the guests acknowledge that the tenancy granted by this agreement is not an assured tenancy and that no statutory periodic tenancy will arise when it ends.

Bluebell is categorised as a Site of Special Scientific Interest and an area of great landscape value. We kindly request that you are sensitive to this environment.

Quiet times

As we live in the countryside, we would appreciate guests being respectful to the peaceful environment and observe a quiet time between 10 pm and 7.30 am.  We do not allow any parties or events.

We reserve the right to ask guests who contravene these terms and conditions or who in any other way are behaving in a manner likely to cause nuisance or distress or if any activity is undertaken which is illegal, to leave immediately. In these circumstances the holiday ceases and we shall not be liable for any extra costs incurred by you. The terms contained in this contract do not affect your statutory rights.

Arrival/departure times

Our arrival time is 4 pm and our check out time is 10 am.  Please let us know in advance by email your estimated arrival time: Bluebellriversidecabin.co.uk   The key code for the key safe will be sent to you a day before arrival.

General

The price paid includes bed linen, towels, bath mat, tea towels, oven glove, washing up liquid, some dishwasher tablets, handsoap, bin liners, salt, pepper, olive oil, kitchen cloth, firelighters, matches ,welcome sachets of tea and coffee, toilet rolls. A basket of kindling and two bags of logs.

The guest must accept that minor differences between text/photograph/illustrations on the website and the actual property may arise. We cannot accept responsibility should the property not conform to the guest’s standards. If a facility is particularly important to you, please check with us prior to your booking.

Booking

You as the person in charge of the party (the party leader) must be at least 18 years old at the time of booking. All other members of the party must authorise you to make the booking on the basis of these conditions. By making the booking, you confirm that you are authorised to make the booking and that all other members of the party agree that the booking will be governed by these conditions. You are responsible for making all payments due to us.

We reserve the right to refuse any booking before we send you your written confirmation. If we do this, we will tell you in writing and promptly refund any money you have paid to us. In this case, we will not have any legal responsibility to you. When you receive your confirmation, you must check the details carefully. If anything is not correct, you should tell us immediately.

A 30% deposit is required on booking and the balance to be paid no less than 8 weeks prior to arrival.  Your dates are not secured until we have received a deposit and you have received a confirmation letter from us.

We  reserve the right to re-let any holiday where any monies due are more than 14 days in arrears whereupon any monies paid by the guest over and above the deposit will be refunded. However, if we are unable to re-let the holiday the guest will remain liable for the outstanding balance of the cost of the holiday, and (if applicable) the deposit.

In the event of the accommodation becoming unavailable (such as fire or flooding), we will refund all monies paid or a proportion in the case of curtailment. We cannot however pay any compensation or expenses as a consequence of such an event.

Cancellation policy

All cancellations will incur a £35 administration fee; we strongly recommend that you take out holiday cancellation insurance. In the event of cancellation:

  • More than 8 weeks prior to arrival your deposit is non-refundable unless we manage to re-sell the stay for the full period of the reservation. We will partially refund your payment if we manage to re-sell a percentage of your stay, however we will endeavour to do our utmost to sell the full period.
  • Less than 8 weeks prior to arrival the full amount is non-refundable unless we manage to re-sell the stay for the full period of the reservation.  We will partially refund your payment if we manage to re-sell a percentage of your stay, however we will endeavour to do our utmost to sell the full period.

A guest requiring a booking to be altered once the booking has been confirmed will be charged £20.00 if a revised confirmation is required.

Damages

We reserve the right to charge for damage done by guests, although we do not normally charge for minor breakages. We hereby formally disclaim any liability for any losses or injury sustained by guests or their property except where negligence on the part of ourselves or our staff is legally proven. We reserve the right to enter your accommodation giving reasonable notice except in the case of an emergency. You and all members of your party agree to keep the property clean and tidy, to leave the property in a similar condition as you found it when you arrived, and to behave in a way at all times while at the property which does not break any law.  Smoking or vaping in Bluebell is not permitted. If you do smoke please do so outside the property at a safe distance from Bluebell, please bring your own ashtray or means of disposing cigarette ends and do so safely making sure they are completely extinguished.

The use of fireworks is prohibited anywhere at the property due to the fire risk and distress it can cause to animals and wildlife.

Please do not light candles inside Bluebell.

Please remove shoes before entering Bluebell.

Please make sure you lock the doors and close windows, and switch off lights, heating and any electrical appliances when you go out.

Please do not take the towels to the beach or use them to remove makeup.

Please park your car in the parking space designated for Bluebell.

Complaints/concerns

You must notify us of any problems, breakages or complaints immediately so that remedial action can be taken if appropriate. We cannot accept liability for any shortcomings or claim of whatever nature if you fail to notify us of any complaint during your holiday.

Events beyond our control

Unless we say otherwise in these booking conditions, we will not be legally responsible individually for any compensation if we are prevented from carrying out our responsibilities under this contract as a result of events beyond our control. This means an event we could not, even with all due care, expect or avoid including: strike, lock-out or labour dispute; natural disaster; acts of terrorism, war, riot or civil commotion; malicious damage; keeping to any law or governmental order, rule, regulation or direction; accident; breakdown of equipment or machinery; insolvency or bankruptcy of an owner or service provider; fire, flood, snow or storm; difficulty or increased cost in getting workers, goods or transport; and other circumstances affecting the supply of goods or services.

Disabilities/medical conditions

Unfortunately, due to the nature of our grounds, we are not able to accommodate wheelchair users.  If you or any member of your party has any medical problem or disability that may affect your booking, please tell us before you confirm your booking and give us full details in writing as early as possible before you travel. If we feel unable to properly meet that person’s particular needs, we can refuse or cancel the reservation.

Fire notice

Please read the Fire Notice located in the welcome email and manual in Bluebell – the management cannot be responsible for non-compliance with this notice.

Data protection

The information you supply will be stored on computer for administrative purposes. Under no circumstances will this information be provided to a third party. We may from time to time wish to send you news of special offers. If you do not wish to receive any communication from us please let us know.  Full details of our Privacy Policy can be found on our website.

Pets
Unfortunately we are unable to accommodate pets at Bluebell.

The river

It is important to be aware of the risks and dangers of the river including but not limited to slipping, tripping, falling and drowning. 

Steps

Please take care when using the steps at night. There is low level lighting, but please take the torch from the cabin with you if you are out in the dark.

We accept no responsibility for personal injury to the guest and/or his/her invitees (jointly known as “the guests”), or loss of or consequential loss or damage to their property, or for other matters over which we have no control. 

When you arrive:  PLEASE NOTE our check in time is 4 pm to allow us to get the cabin ready for you.  The key will be located in the key safe attached to the river side of the cabin; the code will be sent to you separately. If you need to contact us at any time please do so by text or telephone, and we will assist or arrange to meet you.  

Bluebell has a king-size bed; if you prefer to bring your own bedding and towels please let us know.

We have provided cleaning products and cloths for guests to use and politely ask that guests maintain the cleanliness during their stay. When you leave, we would be grateful if you could please ensure the following:

  • Please open all windows and doors before you leave.
  • Please place the pillowcases, pillow protectors, duvet cover, mattress protector (but not the topper), towels, flannels, bath mat, tea towels and oven gloves in the bags provided, instructions will be in the cabin.
  • Place bed pillows in the black bin bag provided.
  • Please place all unwashed crockery, saucepans, cutlery etc into the dishwasher and switch it on.
  • Please take the rubbish out of all the bins and place in the bins outside.
  • Please leave the key in the door.

Bluebell WiFi

Using our free Wi-Fi access, you agree to the Terms and Conditions below.

This agreement sets out the terms and conditions on which wireless internet access (“the service”) is provided free of charge to you, a guest of Bluebell riverside cabin  (“us”) in consideration for your custom. Usage of which confirms your agreement to these terms and conditions and your agreement to allow us to send to you by e-mail our promotional and marketing material.

  1. Extent of the service
  • We do not recommend in particular the use of any websites (or other internet related services) (“Internet Services”) and your use of Internet Services is carried out entirely at your own risk.

1.2.   We have no responsibility for, or control over, the internet services you access and do not guarantee that any services are error or virus free.

1.3.   We have no responsibility for, or control over, the information you transmit or receive via the service.

1.4.   Save for the purposes of network diagnostics, we do not examine the use to which you put the service or the nature of the information you send or receive.

1.5.   We do not guarantee:

  1. a)   the availability of the service;
  2. b)   the speed at which information may be transmitted or received via the Service; or
  3. c)   that the service will be compatible with your equipment or any software you use.

1.6.   We do not guarantee the security of the information that you may transmit or receive using the service or located on any equipment utilising the service, and you accept that it is your responsibility to protect your information and have adequate security (in terms of equipment and procedures) to ensure the security, integrity and confidentiality of your information and data.

1.7.   We reserve the right at all times to withdraw the service, change the specifications or manner of use of the service, to change access codes, usernames, passwords or other security information necessary to access the service.

  1. Your use of the service
  • You must not use the service to access internet services, or send or receive e-mails, which:
  1. a) are defamatory, threatening, intimidatory or which could be classed as harassment;
  2. b) contain obscene, profane or abusive language or material;
  3. c) contain pornographic material (that is text, pictures, films, video clips of a sexually explicit or arousing nature);
  4. d) contain offensive or derogatory images regarding sex, race, religion, colour, origin, age, physical or mental disability, medical condition or sexual orientation;
  5. e) contain material which infringe third party’s rights (including intellectual property rights);
  6. f) in our reasonable opinion may adversely affect the manner in which we carry out our business; or
  7. g) are otherwise unlawful or inappropriate.
  • Music, video, pictures, text and other content on the internet are copyright works and you should not download, alter, e-mail or otherwise use such content unless certain that the owner of such works has authorised its use by you.
  • We may terminate or temporarily suspend the service if we reasonably believe that you are in breach of any provisions of this agreement including but not limited to clauses 2.1 to 2.2 above.
  • We recommend that you do not use the service to transmit or receive any confidential information or data and should you choose to do so it will be at your own risk.

2.5    The service is intended for consumer use only. In the event that you use the service for commercial purposes we would specifically refer you to clause 5.2 below.

  1. Criminal activity

3.1    You must not use the service to engage in any activity which constitutes or is capable of constituting a criminal offence, either in the United Kingdom or in any state throughout the world.

3.2    You agree and acknowledge that we may be required to provide assistance and information to law enforcement, governmental agencies and other authorities.

3.3    You agree and acknowledge that we may keep a log of the Internet Protocol (“IP”) addresses of any devices which access the service, the times when they have accessed the service and the activity associated with that IP address.

3.4    You further agree we are entitled to co-operate with law enforcement authorities and rights-holders in the investigation of any suspected or alleged illegal activity by you which may include, but is not limited to, disclosure of such information as we have (whether pursuant to clause 3.3 or otherwise), and are entitled to provide by law, to law enforcement authorities or rights-holders.

  1. Our use of your information.

4.1    Subject to clauses 3.3 and 3.4 above we confirm that we shall use the contact details you provide to us solely for the purposes of contacting you with marketing information, updates, promotions and special offers relating to our business.

  1. Other terms

5.1    You agree to compensate us fully for any claims or legal action made or threatened against us by someone else because you have used the service in breach of these terms and conditions, and in particular clause 2.1 to 2.3 and 3.1 above.

5.2    Whilst we do not seek to limit our responsibility for fraudulent misrepresentation or if you are injured or die as a result of our negligence we have no responsibility (to the extent permitted by law) to compensate you (whether or not we are negligent) for any direct financial loss, loss of profit, revenue, time, anticipated savings or profit or revenue, opportunity, data, use, business, wasted expenditure, business interruption, loss arising from disclosure of confidential information, loss arising from or in connection with use of the service or inability to use or access the service or a failure, suspension or withdrawal of all or part of the service at any time or damage to physical property or for any other similar direct loss that may arise in relation to this agreement whether or not we were advised in advance of the possibility of such loss or damage.

5.3    We agree that neither this agreement does not allow either party to act as, or hold themselves out as, acting as an agent of the other party and that that the terms of this agreement are not enforceable by a third party under the Contracts (Rights of Third Parties) Act 1999.

5.4    This agreement is governed by the law of England and Wales and is subject to the non-exclusive jurisdiction of the English courts.
